1. Format of the Contract

1.1 These terms of sale apply to all goods supplied by www.thetravelbuggycompany.co.uk, a trading name of From East Riding Ltd, located at 8 Victoria Street, Goole, East Yorkshire DN14 5DZ.
1.2 No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order, and full payment (in cleared funds) has been received. Upon acceptance, a binding legal contract is established, subject to these Terms and Conditions.
1.3 An acknowledgment of your order will be sent via email upon order placement. However, the acceptance of your offer occurs after payment is received, creating a binding legal contract.
1.4 The contract is subject to your right of cancellation (see below).
1.5 The Supplier reserves the right to change these terms of sale without prior notice, applying to future sales.
1.6 These terms and conditions apply to website sales and phone orders. Different policies apply to in-store purchases.

2. Description and Price of the Goods

2.1 All prices are in £ sterling, exclusive of VAT and delivery charges. VAT will be charged on all items. VAT may be deducted for items eligible for Zero Rate VAT under the VAT Act 1983, provided a VAT exemption declaration form is completed during the purchasing process.
2.2 While efforts are made to ensure accurate stock levels, goods are subject to availability. If ordered goods are unavailable, the Supplier will promptly inform you and issue a refund.
2.3 Prices on the Supplier’s website are accurate at the time of order placement. In case of an error, the Supplier will notify you for order confirmation or cancellation. Failure to confirm within 14 days will result in automatic order cancellation.
2.4 Delivery charges may apply for orders outside normal delivery areas.
2.5 The Supplier reserves the right to refuse an order and will promptly notify you. Please note that items may come at separate times.

3. Payment

3.1 Payment and delivery charges are made through methods listed on the Supplier’s website. Payment is due before the delivery date, and timely payment is crucial.
3.2 The Supplier may withhold delivery until cleared funds are received.
3.3 Payments should be made without deductions unless a valid court order requires a deduction.
3.4 Payment Options: Secure online payments are accepted via SSL technology, including Delta, Maestro, Mastercard, Visa, Visa Electron, and American Express.

4. Delivery

4.1 Delivery is restricted to the United Kingdom, and a delivery charge applies. Delivery must be made to the address registered with your credit card or debit card. All deliveries must be signed for, and receipts should be retained. (Our Delivery prices are for the UK Mainland – For Northern Ireland, the Isle of Wight, Channel Islands, Scottish Islands, and Highlands POSTCODES PO30-41, AB37, IV1-56, KW1 – KW9 PA34 -39, PH19 – 44, BT1 -82, GY1 -10, JE1 – 5 – Additional Charges are applicable – Please contact us prior to placing your order for confirmation of these charges, usually a minimum of £20.)
4.2 All Orders received will be processed the next working day and will be delivered provided no additional security checks are required and all stock items are available. (A working day is any day other than weekends and bank or other public holidays.)
4.3 If delivery cannot be made to your address for reasons under the Supplier’s control, the Supplier will inform you as soon as possible and refund or re-credit you for any sum that has been paid by you or debited from your credit card for delivery.
4.4 Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, the Supplier will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, the Supplier will inform you as soon as possible. Please allow 14 working days for delivery. Although we aim to have your item delivered sooner.
4.5 Time for delivery shall not be of the essence. The goods may be delivered by the Supplier in advance of the quoted delivery date. Please note a relatively able person may be required to unpack some of the products. Our couriers usually deliver between the hours of 8 am up to 18.30hrs.
4.6 Upon receipt of your order, you should check your delivery for any faults or errors. If these are not brought up to us within 3 days after its delivery, we may not be able to do a straight swap.
4.7 OVERSEAS DELIVERY – If your delivery is for Northern Ireland or The Highlands and Republic of Ireland Or another European Country, then please call us so that we may advise on the delivery cost of any item you wish to purchase.
4.8 Any deliveries to the following postcodes will be priced on application and may also be subject to an extended lead time of 10 Working Days – POSTCODES PO30-41, AB37, IV1-56, KW1 – KW9 PA34 -39, PH19 – 44, BT1 -82, GY1 -10, JE1 – 5 – Additional Charges are applicable – Please contact us prior to placing your order for confirmation of these charges, usually a minimum of £20. Deliveries that need to be completed on a specific day may also be priced on the application.

5. Risk/Title

5.1 Goods are at your risk from the time of delivery.
5.2 Ownership does not pass until full payment is received.
5.3 The Supplier may recover payment for goods even if ownership hasn’t passed.

6. Your Right of Cancellation

6.1 You have the right to cancel the contract within 14 working days of receiving the goods.
6.2 Cancellation notice must be given in writing via letter or email.
6.3 If you cancel after receiving the goods, return them at your cost to the address provided, ensuring they’re undamaged.
6.4 Upon cancellation, the Supplier will refund or re-credit within 14 days, subject to inspection.
6.5 Failure to return goods may result in charges for recovering them.
6.6 Damaged goods on delivery should be reported within 7 days.
6.7 Custom-designed, prescribed, or special-order items are non-refundable.
6.8 ALL returns are subject to a 20% restocking charge. If items are cancelled/returned within 14 days of receipt, a collection charge will apply.

7. Warranty

7.1 Products have a 12-month Parts warranty against faulty manufacture or materials. Warranty repairs require returning the product to the Supplier at your cost.
7.2 Warranty exclusions include adjustments, fair wear & tear, user-induced issues, and maintenance requirements. Customer pays return carriage if no fault is found.
7.3 Call-out for product inspection, whether under warranty or not, incurs a £95 engineer call-out charge.
7.4 Defective items due to manufacturing problems are repaired or refunded.

8. Data Protection

The Supplier takes reasonable precautions to secure your order and payment details, complying with the Data Protection Act 1998.

9. Privacy

9.1 The website allows third-party vendors to show ads and use cookies based on users’ prior visits.

Applicable Law

These terms are subject to English law, and English courts have jurisdiction over any disputes.
